Iloilo City — Dapat lantawon ang pangkabilugan nga context ukon ang mensahe nga gusto ipalab-ut sang Skimmers academic group sang University of the Philippines Visayas (UPV) sa kontrobersiyal nila nga cheer routine bangud sang linya nga “Let’s kill this president…charot!”
Suno kay Atty. Eldrid Antiquera, kun sa una pa lang nga parte sang cheering, makita nga luyag nila ganyaton ang publiko nga magkomiter sang sedition, may posibilidad nga may salabton sila sa “inciting to sedition.”
Ang inciting to sedition ginapasaka kontra sa mga wala sang direkta nga papel sa krimen nga sedition, naga-engganyo sa iban nga magkomiter sang seditious acts paagi sa mga speeches, proclamations, sinulatan, emblems, cartoons, banners ukon iban pa nga representation.
Ang inciting to sedition amo ang pagpakigbahin sa mga publication ukon circulation sang “scurrilous libels” batok sa mga otoridad nga magasablag sa opisyal sa pagtuman sang iya katungdanan.
Yari ang probisyon para sa krimen nga inciting to sedition sa idalum sang Article 142 sang Revised Penal Code:
“The penalty of reclusion perpetua to death shall be imposed upon any person who, without taking any direct part in the crime of sedition, should incite others to the accomplishment of any of the acts which constitute sedition, by means of speeches, proclamations, writings, emblems, cartoons, banners, or other representations tending to the same end, or upon any person or persons who shall utter seditious words or speeches, write, publish, or circulate scurrilous libels against the Government of the Philippines, or any of the duly constituted authorities thereof, or which tend to disturb or obstruct any lawful officer in executing the functions of his office, or which tend to instigate others to cabal and meet together for unlawful purposes, or which suggest or incite rebellious conspiracies or riots, or which lead or tend to stir up the people against the lawful authorities or to disturb the peace of the community, the safety and order of the Government, or who shall knowingly conceal such evil practices.”
Sa Revised Penal Code suno kay Atty. Antiquera, isa sa mga elemento amo nga ang isa ka akto ginhimo “willfully and intentionally” buot silingon, may intensyon nga magkomiter sang krimen.
Kun wala sang intensyon sa pagkomiter sang krimen suno kay Antiquera, makabig pa ini nga depensa sa bahin sang ginareklamo.
Sa cheer routine sang Skimmers, kun lantawon lang ang porsyon nga may linya nga “Let’s kill this president, charot!” indi ini makabig nga inciting to sedition bangud sang tinaga nga “charot.”
Importante suno kay Antiquera ang “charot” bangud dire ma-establisar ang intensyon, patimaan nga “joke” ukon lahog lang ang hambal nga patyon ang presidente kag wala sang intensyon nga himuon gid ang akto.
Una na ginbalewala sang Malacañang ang kontrobersiyal nga linya sa Skimmers cheering.
Ginpahayag ni Presidential spokesman Salvador Panelo nga “joke lang” ini kag posible nga ginsunod lang ang masami nga pahayag ni Presidente Rodrigo Duterte nga “kill.”
